Notice to users: the "zero tolerance" standard

The following Content Policy governs all user-generated content (UGC) on The Gay Massage. This policy is not a mere suggestion; it is a set of mandatory rules. Failure to comply will result in immediate content removal, account suspension, or permanent banning.

1. The core mandate: therapeutic focus

The primary purpose of this platform is the discovery of therapeutic bodywork and massage. All content must reflect this professional standard. We operate under a "Strictly Therapeutic" mandate to minimize legal exposure and maintain high-quality listings.

Licensed vs. unlicensed providers: We distinguish two categories of provider. Licensed Massage Therapists (LMTs) hold a New York State massage therapy license. Bodywork Practitioners are not licensed massage therapists. Only LMTs may describe their services as "massage" or "massage therapy." Unlicensed practitioners are listed and described strictly as offering "bodywork," and every listing must accurately reflect the provider's licensure status.

2. Prohibited content (the "red list")

To ensure compliance with federal regulations (including FOSTA-SESTA) and to maintain a professional atmosphere, the following are strictly prohibited in profiles, photos, and reviews:

A. Sexual Services & Solicitation: Any language or imagery that implies or explicitly offers non-therapeutic sexual services is prohibited. This includes, but is not limited to:

  • Explicit mentions of "escort" services.
  • References to specific sexual acts (e.g., "happy endings," "extra services").
  • Language suggesting a transactional relationship based on sex rather than massage/bodywork.

B. Explicit Imagery & Nudity: We require professional presentation. The following are prohibited in profile photos and uploaded media:

  • Full frontal nudity (unless medically/professionally justified, e.g., a professional anatomical photo).
  • Explicitly erotic or "adult" imagery.
  • Highly suggestive or provocative posing that detracts from the therapeutic nature of the service.

C. Defamation & Harassment:

  • Falsehoods: Posting reviews or comments that are demonstrably false or intended to damage a provider's reputation.
  • Harassment: Using profanity, derogatory language, or personal attacks in reviews or messaging.
  • Privacy Violations: Posting the private contact information (phone/address) of others without their express permission.

3. Moderation and enforcement (the "sword")

Company maintains absolute discretion over what content is hosted on the platform. Our enforcement mechanism follows a Reactive and Proactive model:

  • Proactive Review: Company reserves the right to pre-screen or use automated tools to scan for prohibited imagery/text before publication.
  • User Reporting: Users may report any profile, photo, or review that violates these terms using the report button on the listing, which notifies our team at support@thegaymassage.com.

The "Takedown" Protocol: Upon receipt of a report or discovery of a violation, Company reserves the right to:

  • Immediate Removal: Removing the offending content without prior notice.
  • Warning/Suspension: Issuing a formal warning or temporary account suspension.
  • Permanent Ban: Permanent termination of account access for repeat offenders or egregious violations (e.g., blatant sexual solicitation).

4. User obligations and rights

  • Accuracy Warranty: You warrant that all content you upload is your own original work and does not infringe on any third-party intellectual property rights.
  • The Right of Reply: While Company may remove defamatory content, we encourage a culture of professional discourse. Providers may be granted the right to respond to reviews within the platform's interface.

5. Intellectual property and DMCA

All media uploaded to the Site is subject to the Digital Millennium Copyright Act (DMCA). If you are a copyright holder and believe your work has been used without permission, you may submit a formal "Notice of Infringement" to our designated agent.

Designated Agent: Pursuant to the Digital Millennium Copyright Act, The Gay Massage has designated an agent to receive notices of claimed infringement, reachable by email at support@thegaymassage.com.

Notice of Infringement: To be effective, a notice must include: (i) a description of the copyrighted work; (ii) the URL of the infringing material; (iii) your contact information; and (iv) a statement of good faith.

Counter-Notice Process: If you believe your content was removed by mistake, you may submit a counter-notice to support@thegaymassage.com containing your contact info and a statement under penalty of perjury that the material was removed in error.

Repeat Infringer Policy: We maintain a "Three Strikes" policy. Users who repeatedly infringe on intellectual property rights will have their accounts terminated without warning.
